Privacy Policy

AZStudio Inc. (hereinafter referred to as “the Company”) hereby sets forth this privacy policy (hereinafter referred to as “this Policy”) regarding the handling of user information, including personal information of members, in the services provided by the Company (hereinafter referred to as “the Services”).

 

1. Collected User Information and Collection Methods

In this Policy, “User Information” refers to information related to members (including non-members accessing the websites where the Services are provided, and when including non-members, referred to collectively as “Members, etc.”) that is generated or stored on smartphones, tablets, computers, or other devices related to the Members or their devices, including information that can identify an individual, behavioral history within communication services, and other information obtained by the Company in accordance with this Policy. The User Information that the Company obtains in the Services varies depending on the collection method, as described below.

 

  1. Information provided directly by Members To use the Services, you may be asked to provide the following information:

    • Email address, nickname

    • Gender, date of birth

    • Physical information (height, weight, body fat percentage, etc.)

    • Dietary habits (meal content, portion sizes, meal times, etc.)

    • Other information entered by Members into input forms designated by the Company

  2. Information provided by other services through linkage When using the Services, if you authorize linkage with other services (e.g., SNS), the Company will obtain the following information from such services based on the content to which you agreed at the time of authorization:

    • The ID used by the Member on the linked other service

    • Data obtained from Apple’s HealthKit framework (Health app) and Google’s Google Fit

      • Such data is handled in compliance with Apple’s and Google’s terms. It will not be used or disclosed for advertising or similar purposes. Furthermore, except in cases specified in "5. Provision to Third Parties" and "6. Disclosure of Personal Information," it will not be disclosed to any third party without the Member’s explicit consent.

    • Other information that the Member has permitted to be disclosed to the linked service, according to the settings of that other service.

  3. Information provided by a business entity that has executed a business partner contract (hereinafter “Business Contract”) with the Company
    If the Member is able to use the Services through a Business Contract between the Company and a business entity (corporations, organizations, sole proprietors, etc.), the Company may obtain the following information from said entity:

    • Member’s identification information held by the business entity (such as employee number, insurance card number, etc.)

    • Other information agreed upon based on the Business Contract between the Company and the entity

  4. Information about access and usage of the Services by Members, etc.
    The Company may obtain information regarding the Member’s access status and usage methods of the Services, including:

    • Device information

    • Log information

    • Cookies and anonymous IDs

    • Location information

 

2. Purposes of Use
  1. User Information is used primarily for providing the Services, as described in Section 2-2, and may also be used for other purposes as described in Section 2-3.

  2. The specific purposes of use of User Information related to the provision of the Services are as follows:

    1. To provide, maintain, protect, and improve the Services, including registration acceptance, identity verification, calculation of usage fees, etc.

    2. To respond to inquiries regarding the Services

    3. To provide information about the Services or related events, and to request participation in surveys or interviews

    4. To provide automatically generated nutritional advice or similar information based on gender, weight, and other physical information, as well as meal and exercise content

    5. To use in counseling services (e.g., dietary guidance) provided face-to-face, by phone, or by email, based on gender, weight, and other physical information, as well as meal and exercise content

    6. To bill usage fees to those Members who use paid services

    7. To use for the Company’s own research, marketing activities, and AI learning after processing so that no specific individual can be identified, or by performing statistical processing

    8. In the case of a Business Contract, to support the implementation and planning of health measures or similar initiatives of the contracted business entity in accordance with the contract terms

    9. To address acts that violate the Company’s terms, rules, policies, etc. (hereinafter “Terms, etc.”) related to the Services

    10. To notify of changes to the Terms, etc. of the Services

    11. For purposes associated with the above purposes of use

  3. The other purposes of use besides those described in Section 2-2 are as follows:

    1. The following information may be used, after processing so that no specific individual can be identified or after performing statistical processing, for provision to research institutions or the Company’s business partners (hereinafter collectively referred to as “Information Recipients”) in connection with the Company’s services:

      • Date of birth

      • Gender

      • Weight, height, body fat percentage recorded in the Services

      • Dietary and exercise records in the Services

    2. The following information may be used for the Company’s marketing activities and for delivering or displaying advertisements by the Company or the Company’s advertising client companies:

      • Device information

      • Log information

      • Cookies and anonymous IDs

      • Location information

      • Date of birth

      • Gender

      • Weight recorded in the Services

      • Height, body fat percentage

      • Dietary and exercise records in the Services

    3. The following information may be used to request cooperation with surveys regarding the Company’s products or the Services:

      • Email address

      • Date of birth

      • Gender

      • Other information entered by the Member in the input forms designated by the Company

  4. The following information may be used for shipping the Company’s sold products or for conducting lotteries and sending prizes in campaigns:

    • Address

    • Name

    • Telephone number

  5. The following information may be used for other marketing purposes:

    • Date of birth

    • Gender

    • Postal code

    • Location information

 

3. Voluntariness and Accuracy of Personal Information

If required items are not entered, it may not be possible to receive the Services. Furthermore, Members, etc. shall be responsible for ensuring that the personal information provided is accurate and up-to-date.

 

4. External Transmission, Third-Party Provision, and Information Collection Modules

For the purpose of delivering targeted advertisements using User Information, the Services incorporate information collection modules. As a result, User Information may be provided to the providers of these information collection modules. However, these details do not include information that could identify an individual.

 

5. Provision to Third Parties

The Company will not provide personal information included in User Information to third parties without the prior consent of the Member, etc., except where disclosure is permitted by the Personal Information Protection Act or other laws and regulations. However, this does not apply in the following cases:

  1. When entrusting the handling of personal information in whole or in part to the extent necessary for achieving the purposes of use

  2. When personal information is provided due to business succession resulting from a merger or other reasons

  3. When providing information to Information Recipients in accordance with Section 2-3-1, or providing information to providers of information collection modules in accordance with Section 4

  4. When cooperation is required for a national or local government body, or an entity entrusted by them, to conduct affairs prescribed by law, and obtaining the consent of the Member, etc. would likely impede the execution of such affairs

  5. When providing necessary personal information to a business entity with which there is a Business Contract, pursuant to said contract

  6. Other cases where disclosure is permitted by the Personal Information Protection Act or other laws and regulations

 

6. Disclosure of Personal Information

If the Company receives a request from a Member, etc. for disclosure of their personal information pursuant to the Personal Information Protection Act, the Company will confirm that the request is made by the individual in question and will disclose the information without delay (or notify if such personal information does not exist). However, the Company may choose not to disclose all or part of the information if any of the following conditions apply:

  1. If there is a risk of harm to the life, body, property, or other rights or interests of the individual or a third party

  2. If there is a risk of encouraging or inducing illegal or wrongful behavior

  3. If there is a risk of causing significant hindrance to the proper execution of the Company’s operations

  4. If disclosure would violate other laws and regulations

Procedure for Requesting Disclosure, etc.:

Please apply via the inquiry form at corp.azstudioinc.com, attaching a URL link to documents that can confirm your identity (copies of official documents such as a driver’s license, passport, etc.).

 

7. Correction and Suspension of Use of Personal Information
  1. If the Company receives a request from a Member, etc. to correct personal information based on the Personal Information Protection Act on the grounds that the personal information is not true (1), or if the Company receives a request to suspend the use of personal information based on the Personal Information Protection Act on the grounds that it is being handled beyond the scope of previously disclosed purposes of use, or that it was collected through deception or other wrongful means (2), the Company will verify that the request is from the individual in question, and promptly conduct the necessary investigation. Based on the results, the Company will correct or suspend the use of the personal information and notify the Member, etc. If the Company decides for a reasonable reason not to correct or suspend the use of the information, it will notify the Member, etc. of that decision.

  2. If the Company is not obligated under the Personal Information Protection Act or other laws and regulations to correct, suspend use, etc. of the personal information, the provisions of the preceding paragraph do not apply.

  3. Depending on the content of the Member’s personal information, certain information may be fundamental to the acquisition or use of the Services. In such cases, suspension of use may necessitate cancellation of the Service subscription.

9. Procedures for Changing the Privacy Policy

The Company will review the operational status of the handling of User Information from time to time and strive for continuous improvement, and may change this Policy as necessary. In case of changes, the Company will notify or post the changes on the Services or the websites where the Services are provided. If a Member uses the Services after notification of the change, the Company will consider that the Member has agreed to the change. However, if the revision requires Member, etc. consent under laws and regulations, the Company will obtain the consent in a manner prescribed by the Company.
